The insolvency team advises on all aspects of corporate and personal insolvency (including liquidations, administrations, receiverships, bankruptcies and voluntary arrangements), but with a particular focus on the insurance and reinsurance sector, for which it is listed in the Legal 500.
The team receives instructions from leading insolvency practitioners as well as representing major commercial entities with interests in London market insolvencies. Working across all of the firm's practice groups, we understand different commercial areas.
The team has developed a very strong reputation for its work in connection with the insolvencies of re/insurance intermediaries and underwriting agencies, being instructed by leading insolvency practitioners in this area. It is well known also for its work in relation to entities that are in run-off. The team is regularly called on to advise about schemes of arrangement (both insolvent and solvent) in the re/insurance sector. It also acts on difficult reinsurance recoveries with recalcitrant debtors.
When dealing with pre-insolvency issues, we work with both creditors and debtors addressing issues prior to the onset of insolvency such as wrongful and fraudulent trading issues, as well as directors' liability issues. We advise on restructuring and the sale/transfer/acquisition of books of business or entire organisations, and work closely, where appropriate, with insolvency practitioners.
Be it trust disputes on insolvency, tracing claims, issues of set-off, making or opposing statutory demands and winding ups, the team is well able and experienced to assist, having acted in some capacity in relation to major insolvencies such as HIH and NewCap Re as well as Reliance Insurance.
